Youth Athlete Merchandise Agreement

This Agreement (the "Contract") is made and entered into on [Date of Form], by and between [Parent/Guardian’s Full Name (on form)], on behalf of their child, [Child's Full Name (on form)] ("Athlete"), and MyPlayer Athlete LLC, an NIL company ("MyPlayer") of Glenview, IL.

Scope of Agreement

The Parent/Guardian grants MyPlayer the right to use their child’s name, image, and likeness ("NIL") to create and sell merchandise (e.g., T-shirts, hoodies, etc.) featuring the child’s image. This includes but is not limited to:

Creating custom merchandise.

Promoting the child’s merchandise on MyPlayer’s website and social media platforms.

Photo Release

By signing this Agreement, the Parent/Guardian grants MyPlayer permission to use any photos or images of the child submitted through the form for the purpose of creating merchandise. These photos will be printed on clothing and potentially used in promotional materials.

The Parent/Guardian acknowledges that the child’s image will be visible to anyone purchasing the merchandise.

Liability

MyPlayer is not responsible for or liable for who purchases the merchandise that features the child's image. The Parent/Guardian understands and agrees that anyone, including individuals outside the child’s direct network, may purchase the merchandise. MyPlayer is not responsible for monitoring or restricting the buyers of these items.

Parental Consent

This Agreement must be signed by the Parent/Guardian of the child. The child is not authorized to sign up for this merchandise program directly. The Parent/Guardian agrees to assume full responsibility for entering into this Agreement on behalf of the child.

Term and Termination

The duration of this Contract begins on the launch date of the custom merchandise collection and remains in effect until terminated by either party. The Parent/Guardian may request the removal of the child’s merchandise from MyPlayer’s platform with 7 days' written notice.

Intellectual Property Rights

The Parent/Guardian retains ownership of the photos submitted but grants MyPlayer a non-exclusive, royalty-free license to use them for the purposes outlined in this Contract. MyPlayer will not use the child's image for any purpose outside the agreed-upon merchandise without further consent.

Governing Law

This Contract shall be governed by and construed in accordance with the laws of Illinois.

Force Majeure

Neither party shall be liable for any failure or delay in performance under this Contract due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.

Social Media and Publicity

The Parent/Guardian agrees that the child’s image may be used in MyPlayer’s social media and promotional campaigns, and will be posted publicly on merchandise.

Entire Agreement

This Contract constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, and agreements, whether oral or written.

Acknowledgment

By signing below, the Parent/Guardian acknowledges that they have read and understood the terms of this Contract and agree to be bound by them.
